Terms and Conditions
In order to become a customer of Hawkesbury Innovations, or a user of any of Hawkesbury Innovations services you must agree to the following terms and conditions.
Site Activation
On completion, your website design will be displayed on a test site. Upon approval of the design:-
Customer selects payment option of 1 months, 6 months or 12 months.
Once first payment is received the website will be activated.
Account cancellations
1. If a customer is found breaching these terms and conditions, the service will be terminated immediately with no refund.
2. For any account to be cancelled you will need to contact the team to receive the required form.
3. Minimum Term – 12 months, a cancellation fee of $200 applies to all accounts that terminate before this time.
Domain Registration
1. Hawkesbury Innovations does not guarantee the requested domain names are available or are able to be registered.
2. Hawkesbury Innovations pays for the first 2 years domain name registration
Web Design
1. Hawkesbury Innovations will design the website free of charge.
2. Hawkesbury Innovations reserve the rights to the website design.
3. The website design cannot be transferred away from Hawkesbury Innovations.
4. All photos/pictures, and wording supplied to Hawkesbury Innovations for the express purpose of the individuals website design will remain the property of that individual.
5. Add on’s incur an added fee separate from the package deal.
6. Two free changes are offered per year and include updated text, photos, removal of invalid information. It does not include website redesign.
7. Extra changes that are required incur a flat fee of $45 per change.
8. Extra pages required other than stated in the package deal incur a $5 fee per month.
Transfer
1. The customer may not transfer this agreement without the written consent of Hawkesbury Innovations.
2. The Website cannot be transferred away from Hawkesbury Innovations.
3. If the customer wishes to transfer the domain name they may do so without transferring the design.
4. If the customer wishes to transfer the design an agreement must be made with Hawkesbury Innovations beforehand.
General
1. Hawkesbury Innovations reserves the right to refuse service to anyone.
2. Hawkesbury Innovations reserves the right to suspend or cancel a customer's access to any or all services provided by Hawkesbury Innovations when Hawkesbury Innovations decides that the account has been inappropriately used or otherwise abused.
3. Under no circumstances must our service be used for the hosting of, reference to or linking to any of the following:
- Illegal material, including copyrighted works, commercial audio, video, or music files, and any material of any type in violation of any Federal, State or Local law or regulation anywhere in the world.
- Adult material including nudity, pornography, anything of a sexual, lewd, or obscene nature content of any type.
- threatening, abusive, harassing, defamatory statements
- promotion of illegal activities (hacking, cracking, etc)
- information or software containing or about any kind of virus
- hate speech or hate propaganda
- content deemed by us at our sole discretion to be harmful to us
Billing
1. The customer agrees to supply appropriate payment for the services received from us in advance of 30 days during which such services are provided. Once you have selected a payment option, unless you inform us of any changes required via email or through our contact form, you will be automatically billed in this time frame.
2. All invoices will be sent via email. Customers are required to pay their invoice in advance (30 days) at the beginning of each payment term using the available payment method of Direct Deposit, Mail (Cheque or Money Order) or Online via PayPal within 12 days of the invoice issue date.
3. If your account becomes 10 days overdue your account becomes temporarily suspended (Website removed). You then have 7 days before it becomes fully suspended (Website removed, Email removed).
4. We reserve the right to cancel any account after 30 days have passed without due payment being received. Any added time for payment will be at our sole discretion.
5. After 30 days if the client still requires the services of Hawkesbury Innovations, Hawkesbury Innovations reserves the right to request that payment be made 6 months in advance before the website is activated once more.
Customer Responsibility
1. Customers are responsible for keeping their usernames, passwords and other sensitive data, safe. If a breach is suspected, the customer is required to request a change of login details by contacting our team.
2. Customer is responsible for keeping their details up to date. Any changes of address or phone numbers should be forwarded to us via our contact form or email.
Hawkesbury Innovations reserve the right to add, delete, or modify these Terms and Conditions, our hosting packages, prices and website at any time with notice provided via website or email.
